The Motor Vehicles Act has gotten stricter

Riding without a helmet is one of the most common traffic offences committed in the country. But wearing a helmet alone too, cannot save you from facing fines. The Motor Vehicles Act, an act made to consolidate and amend laws relating to motor vehicles has just gotten stricter. You can get fines worth up to Rs 2,000 despite wearing a helmet. How? Here’s what the act says:

The act now says that the rider must have his helmet strapped onto his/her head. If the strap is outside the buckle, it could attract a fine of Rs 1,000 according to section 194D. Adding to that, if the helmet is found to be defective or isn’t a BIS (Bureau of Indian Standards)- certified one, you’d have to shell out an extra Rs 1,000 under the same section. Such a situation might make you have to pay Rs 2,000 despite wearing a helmet.  This means that even if you’re wearing a premium ECE or DOT certified helmet, you’ll still be fined if they’re not BIS-certified as well.

The Ministry of Road Transport and Highways recently updated the rules regarding carrying children under four years of age on two-wheelers. It’s now not only mandatory for riders to use helmets and harness belts for children too, but they’ve to limit their speed to 40kmph too. Violation of this rule will not only attract a fine of Rs 1,000 but also invite a three-month suspension of one’s driving license.

This a welcome move by the Government of India as it enhances the safety of the rider. More often than not, riders fail to secure their helmets. If you’ve not strapped your helmet on, it’s as good as you not wearing one, since the helmet won’t be buckled onto your head, rendering it useless.
